General terms and conditions of business
General Terms and Conditions (GTC) for CMA Wild Meat Trade
Status: January 23, 2025
1. Scope
These General Terms and Conditions (GTC) apply to all orders and deliveries between the company CMA-Wildfleischhandel, 1190 Vienna, Austria (hereinafter referred to as "Seller") and its customers via the online shop cma-wildfleischhandel.at.
2. Conclusion of contract
The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order. The ordering process in our online shop includes the following steps:
- Select the desired products and add them to the shopping cart
- Entering the delivery and billing address
- selection of payment method
- Check and confirm the order by clicking on the "Buy now" button
By clicking the "Buy now" button, you place a binding order for the goods in your shopping cart. Confirmation of receipt of the order will be sent immediately after the order has been sent and does not constitute acceptance of the contract. A purchase contract is only concluded when we accept your order by sending an order confirmation by email or by delivering the goods.
The contract data is saved for invoicing purposes and can be viewed in your customer account.
The contract, order and business language is German.
We sell to both consumers (B2C) and businesses (B2B).
3. Prices and shipping costs
All prices are final prices in euros and include VAT. Orders can only be placed with a minimum order value of €49. We deliver free of charge within Vienna, with no additional charges.
There are no additional costs such as packaging or handling fees.
4th delivery
Delivery is only made within Vienna to the delivery address you have specified. For orders from other EU countries, please contact us by email. Delivery times can be viewed on our website at cma-wildfleischhandel.at. If an ordered product is not available, we reserve the right not to deliver it or to do so at a later date. In this case, we will inform you immediately and immediately refund any consideration already received.
When the goods are shipped, the risk of loss or damage to the goods only passes to the consumer when the goods are delivered to the consumer or to a third party other than the carrier designated by the consumer. However, if the consumer has concluded the transport contract himself without using a selection option suggested by us, the risk passes when the goods are handed over to the carrier.
5. Terms of payment
We accept the following payment methods:

Credit card (Eurocard/MasterCard, Visa, American Express...) When paying by credit card, the charge is made on the same day. When paying by credit card, the customer provides the following data: cardholder, card number, credit card company, expiration date, CVV code. The data is transmitted using SSL encryption with at least 128-bit keys and is therefore not visible to unauthorized persons. Transfer If the payment method is bank transfer, the customer must make the payment within one week of receiving the order confirmation. Delivery will only take place after receipt of payment.

PayPal You can order from us cashlessly with PayPal. If you choose this payment method, you will be redirected directly to PayPal for payment. If you already have a PayPal account, you can log in with your account details and make the payment. If you are new to PayPal, you can create a user account free of charge by entering your bank or credit card details. You then pay by entering your email address and a password and receive a payment confirmation by email. Your order will then be processed immediately. Klarna When paying via Klarna, online banking access is required. You will be redirected directly to Klarna to make the payment. You must provide your name, email address and, if applicable, your address.
The purchase price is due upon conclusion of the contract. If you select the payment method "Klarna", the payment will be processed via Klarna Bank AB (publ).
6. Right of withdrawal
Consumers have a legal right of cancellation. Since our products are perishable goods, there is no right of cancellation according to Section 18 Paragraph 1 Item 2 of the Distance Selling Act (FAGG). Please therefore check your order carefully.
7. Warranty and Liability
The statutory warranty rights apply. Our liability for slightly negligent breaches of duty is excluded unless essential contractual obligations, damages resulting from injury to life, body or health or guarantees are affected. The same applies to breaches of duty by our vicarious agents.

9. Applicable law and place of jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that it does not restrict any mandatory legal provisions of the state in which the consumer has his or her habitual residence. The place of jurisdiction for all disputes arising from contractual relationships between the customer and the seller is Vienna, provided that the customer is a merchant, a legal entity under public law or a special fund under public law.
10. Severability Clause
Should individual provisions of this contract be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, the validity of the contract shall otherwise remain unaffected.
